I am writing in reply to your letter requesting an interpretation of Agriculture and Markets Law Section 356.
Pursuant to Agriculture and Markets Law Section 371, the provisions of Article 26 of the Agriculture and Markets Law, such as section 356, are not enforced by this Department, but by constables, police officers and agent or officers of any duly incorporated societies for the prevention of cruelty to animals. Violations of such statutes are prosecuted by the District Attorney of the county in which the alleged offense took place. Opinions interpreting the provisions of Article 26 are issued to public officials by the New York State Attorney General.
